Organistrum: Terms of Use
Organistrum is designed to facilitate the sharing and renting of early music instruments between individuals, ensembles, festivals, and institutions. REMA provides the platform, but is not a party to rental agreements and does not act as an intermediary in transactions.
1. User Responsibilities
1.1 For Instrument Providers
If you publish an instrument for rent:
You confirm that you are legally entitled to offer the instrument for rent.
You are responsible for the accuracy of all information provided.
You agree to clearly define your rental terms, including price, insurance requirements, restrictions, and logistics.
You agree not to upload false, misleading, offensive, or unlawful content.
1.2 For Renters
If you contact an instrument provider:
You must respect the provider’s terms and communicate in good faith.
You are responsible for clarifying and agreeing on rental terms directly with the provider.
You acknowledge that REMA is not responsible for the condition, availability, or delivery of instruments.
2. Platform Use and Conduct
You agree to use the Platform for its intended purpose: connecting the early music community for legitimate instrument rentals. You must not:
Use the Platform for illegal activities.
Post or transmit harmful or malicious code.
Impersonate another person or entity.
Attempt to bypass platform security or collect other users’ data without consent.
3. Accounts and Profiles
Users may be asked to register and create a profile. You are responsible for maintaining the confidentiality of your login credentials.
You agree to keep your contact and profile information accurate and up-to-date.
4. Data Protection and Privacy
REMA takes measures to ensure the security of the data you transmit but advises you to take necessary precautions due to inherent risks of the internet.
In accordance with the French Data Protection Act of 6 January 1978, amended in 2004, the files created with your information have been exempt from declaration No. DI-007 to the Commission Nationale Informatique et Libertés (CNIL).
REMA undertakes not to disseminate the data concerning you to third parties, nor to use it for commercial purposes. Your data will only be used to facilitate contact between users and improve the functionality of the Platform.
You have the right to access, modify, rectify and delete your personal data in accordance with the French Data Protection Act. To exercise this right, please contact us at info@rema-eemn.net.
5. Intellectual Property
All platform content, including structure, design, and classification, is the intellectual property of REMA or its contributors and may not be reused without permission.
Users retain ownership of the content (texts, images, videos) they upload, but grant REMA a non-exclusive license to display it on the Platform.
6. Liability Disclaimer
REMA provides the Platform ‘as is’ and makes no warranty regarding its uninterrupted access or freedom from errors.
REMA is not responsible for any damage, loss, or dispute arising from rentals arranged through the Platform.
All agreements and transactions are made directly between users.
7. Moderation and Suspension
REMA reserves the right to remove content, suspend accounts, or restrict access in case of misuse, non-compliance, or suspicion of fraud.
If you see inappropriate content or behavior, please report it via info@rema-eemn.net.
8. Changes to the Terms
REMA may update these Terms at any time. Continued use of the Platform implies acceptance of the most recent version.
9. Governing Law
These Terms shall be governed by and construed in accordance with French laws, without regard to its conflict of laws principles.
